Is Homeschooling Legal in Utah?

Yes — and Utah is one of the least regulated states for homeschoolers. Under Utah Code Ann. § 53G-6-204 (amended May 7, 2025), here’s what’s required:

  • File a one-time notice of intent. Submit a notice of intent to your local school board for each child when you start homeschooling. (This replaced the old affidavit requirement in 2025 — if you already filed an affidavit, you don’t need to refile.)
  • Receive your excuse certificate. Within 30 days, the school board sends written acknowledgment of your homeschool program. You don’t need to refile as long as you keep homeschooling.
  • No required subjects, no required days of instruction, and no testing. The parent is solely responsible for choosing instructional materials and textbooks.
  • No teacher qualifications required.

It’s about as simple as homeschool law gets — and it still leaves the biggest job, teaching, entirely on your shoulders.

Does Utah Help Pay for This?

Utah Fits All Scholarship is open to homeschoolers and worth roughly $4,000–$6,000 a year — enough to fully cover GCE’s tuition. It’s a capped program awarded by lottery, and it’s currently under legal appeal.
