Is Homeschooling Legal in Texas?
Yes — and it’s remarkably unrestricted. In the landmark 1994 case Leeper v. Arlington ISD, the Texas Supreme Court ruled that a homeschool operating in good faith qualifies as a private school, which means it’s exempt from compulsory-attendance rules. You do not need the state’s permission to homeschool your child.
In 2025, Texas went a step further. The Homeschool Freedom Act (HB 2674), signed by Governor Abbott and in effect since September 1, 2025, bars the Texas Education Agency and the State Board of Education from adding new homeschool regulations without the legislature’s approval. In plain terms: the freedom Texas families enjoy today is now locked in.
What that means for you:
- No registration or notification. You don’t file paperwork or ask a district for approval before you begin.
- No state testing. Homeschoolers are not required to take the STAAR or any standardized test.
- No teacher certification. You don’t need a degree or credential to teach your own child.
The one exception: if your child is currently enrolled in public school, send the district a short letter of withdrawal stating your intent to homeschool. That’s it.
What Texas Requires You to Teach
Texas keeps the bar clear and simple. Your instruction must be genuine (not a sham), delivered in visual form (books, workbooks, or online lessons), and cover five subjects:
- Reading
- Spelling
- Grammar
- Mathematics
- Good citizenship (civics — U.S. and Texas history, government, and the like)
